Learned counsel for the petitioner is directed to remove the defect(s) as pointed out by the office within a period of four weeks.

The petitioner seeks bail in a case registered under Sections-406, 419, 420, 467, 468, 471, 120(B) of the Indian Penal Code.

Allegation against the petitioner is of involving in illegal allotment of Bazar Samiti shops in Patna. It has been submitted that the petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is in

Patna High Court CR. MISC. No.46645 of 2022(2) dt.20-12-2022 2/2 custody since 31-01-2022. Charge sheet has already been submitted in this case. The petitioner has been made accused due to mistake of fact. There is no document on record to show that any money was taken by the petitioner. The petitioner is neither a government official nor he is an office bearer of the agriculture produce market, Gulabbagh. He had no authority to make such allotment. The other co-accused has already been granted bail vide Annexure-2 to this petition. On behalf of the State, it is submitted that the petitioner is named in the FIR.

Considering the aforesaid facts and circumstances of the case, let the petitioner named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Purnea in connection with Supplementary Purnea Sadar P.S.
