1. Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

2. This application, for grant of anticipatory bail, arises out of Chapra Muffasil Police Station Case No. 193 of 2021, disclosing offences under Sections 341, 323, 324, 307, 379, 504, 506 of the Indian Penal Code.

3. As per the prosecution case, on 26.04.2021, in the evening, the informant along with his brother and other family members was going somewhere on his vehicle. At that time marriage procession was going on and some of the members of marriage procession were dancing on the road. When the informant intervened, the accused persons assaulted him with legs, fists

Patna High Court CR. MISC. No.50757 of 2024(4) dt.29-11-2024 2/3 and slaps. Upon seeing this Ankit Raj came to rescue, then the petitioner assaulted Ankit Raj on his back by means of knife.

4. Learned counsel for the petitioner submits that injury attributable to the petitioner is simple in nature. He further submits that similarly situated co-accused persons Saryu Manjhi @ Saryug Manjhi and Rintu Manjhi @ Rintu Kumar @ Rittu Kumar have been extended the privilege of anticipatory bail by this Court vide order dated 11.11.2024 passed in Cr. Misc. No. 72600 of 2024.

Having regard to the submissions made on behalf of the parties, taking into consideration the nature of allegation and the fact that the injuries caused to the victim - Ankit Raj by the petitioner are simple in nature, as such, I am inclined to grant the petitioner the privilege of anticipatory bail.

6. This application is, accordingly, allowed.

7. Let the petitioner, above named, in the event of his arrest or surrender before the Court below within four weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Saran at Chapra in connection with Chapra Muffasil Police Station Case No. 193 of 2021 subject to the condition laid down under Section 438 (2) of
