The petitioner apprehends his arrest in a case for the offence punishable under Section 420 of the Indian Penal Code. This petition stands disposed of with a liberty to the petitioner to move learned Judicial Magistrate, 1st Class, Rohtas at Sasaram in Complaint Case No. 118 of 2014 who will pass order in view of the direction given by the Hon'ble Supreme Court in the case of Arnesh Kumar vs. State of Bihar & Anr., reported in 2014(3) PLJR 314 (SC) on the same day.

It is made clear that the said decision is also applicable in a complaint case.
