ANJANA MISHRA ORAL ORDER 14-07-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner apprehends his arrest in connection with a case registered for the offences punishable under Sections 409/ 420/467/468/471 and 34 of the Indian Penal Code. The allegation against the petitioner is that in collusion with the other co-accused persons, the petitioner paid rupees thirty-five thousand as cashier of Uttar Bihar Gramin Bank, Chamua which had been sanctioned to one Rinki Devi by the Mukhiya, Panchayat Sachiv and Branch Manger. The petitioner has limited role to play. He has to release money as a Cashier only after the sanction as made by the aforementioned persons.

No.27601 of 2017 (3) dt.14-07-2017 P2/2 Considering the fact that the aforementioned amount of rupees thirty-five thousand was not sanctioned by the present petitioner rather only paid in pursuance of the sanction order and that the said thirty-five thousand rupees has now been returned by the Rinki Devi as submitted by learned counsel for the petitioner as stands recorded in A.B.P. No. 712 of 2017 and A.B.P. No. 652 of 2017, let the petitioner abovenamed, in the event of his arrest / surrender within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bettiah, in connection with Shikarpur P.S. Case No. 404/2012, subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
