2. The petitioner is in custody in a case registered for the offence punishable under Section 30(a) of the Bihar Prohibition & Excise Act, 2016/2022(As amended).

3. As per allegation in the FIR, total 71.250 illicit liters of foreign made liquor has been recovered from a hut.

4. Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case. He next submits that nothing has been recovered from the conscious possession of the petitioner nor the petitioner is the owner of the said hut and he has no concern about the recovery of the seized liquor, petitioner has got clean antecedent as stated in para-3 of

Patna High Court CR. MISC. No.45268 of 2026(2) dt.08-07-2026 2/2 the petition and he is in custody since 27.05.2026.

5. Learned APP for the State opposes the prayer for bail of the petitioner.

6. In view of the aforesaid submissions as made by learned counsel for the petitioner, let the above named petitioner be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Exclusive Special Excise Court-I, Darbhanga in connection with Excise Sadar P.S. Case No. 207 of 2026.
