2. Petitioner apprehends his arrest in a case registered for the offence punishable under Section 323, 379, 448 and some other ancillary Sections of the Indian Penal Code.
3. As per the prosecution case, on the alleged date and time of the occurrence this petitioner, armed with weapon, entered into the house of informant and abused and assaulted her. It is further alleged that petitioner snatched her golden chain and also took out Rs. 12,000/- from the pocket of her husband.
4. Learned counsel appearing for the petitioner submits that petitioner is innocent and has falsely been implicated in the case. It is further submitted that both parties are next door neighbour and they are on litigating term for last 30 years. The occurrence took place on account of family feud
Patna High Court CR. MISC. No.48049 of 2023(2) dt.22-08-2023 2/2 which is apparent from the FIR. It is next submitted that with intervention of well wishers the matter has been compromised between the parties.
5. Learned counsel appearing for the State opposes the prayer for anticipatory bail.
6. Considering the facts of the case, nature of accusation against the petitioner, let the petitioner, above named, in the event of his arrest/ surrender within a period of six weeks from today shall be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Gaya in connection with Atri PS case No. 168/ 2020, subject to conditions laid down u/s 438(2) of the Cr. P. C. (Prabhat Kumar Singh, J) BKS/- U T
