JUSTICE VINOD KUMAR SINHA ORAL ORDER 10-07-2019 This is an application for grant of anticipatory bail in connection with Harpur P.S. Case No. 29 of 2019, disclosing offences under Sections 341, 323, 307, 504, 34 of the Indian Penal Code.
Prosecution story is that petitioner and three other accused persons assaulted the informant by Garasa, Khanti and Danda, causing injury.
Submission of the learned counsel for the petitioner is that there is case and counter case. No specific allegation has been attributed against him and he is ready to abide by any condition imposed upon him.
Heard learned A.P.P. also who has opposed the prayer for anticipatory bail on the ground that altogether the informant has received four injuries and three injuries on the head and the
Patna High Court CR. MISC. No.42669 of 2019(2) dt.10-07-2019 2/2 opinion of the same is still reserved.
Having heard both sides, in view of the facts and circumstances, as stated above, I am not inclined to grant privilege of anticipatory bail to the petitioner, however, the petitioner may move before the learned court below for regular bail which will be considered by the learned court below, on its own, without being prejudiced by order of this Court, and if possible, be disposed of on the same day.
