The petitioner seeks bail in anticipation of his arrest in connection with Meenapur P. S. Case No. 256 of 2020, dated 11.07.2020, instituted for the offences under Sections 272, 273 and 34 of the Indian Penal Code and Sections 30(a) and 41 of the Bihar Prohibition and Excise Act, 2016.
According to the F.I.R. 94.32 litres of liquor is said to have been recovered from the poultry farm belonging to the petitioner.
Patna High Court CR. MISC. No.1305 of 2021(2) dt.08-07-2021 2/2 Regard being had to the afore-stated recovery from the place belonging to the petitioner, I am not inclined to grant anticipatory bail to him.
The prayer for anticipatory bail is, therefore, rejected.
However, if the petitioner surrenders before the court below and seeks bail, that shall be considered on its own merits, without being prejudiced by the fact that the present petition on his behalf has not been entertained by this Court.
