Apprehending his arrest in connection with complaint case no. 114 of 2011, registered under section 498A of the IPC, the petitioner has approached this court for grant of anticipatory bail.
Learned counsel for the petitioner submits that the marriage was solemnized in 2005 and several years thereafter the complaint was filed. Drawing attention of the Court to the impugned order, it has been submitted that despite notice by the learned Court below, the complainant did not appear. He further submits that he would make sincere efforts to resolve the
Patna High Court Cr.Misc. No.25080 of 2017 (2) dt.07-07-2017 2/2 matrimonial discord with his wife.
In the facts and circumstances of the case, in the event of his arrest or surrender before the Court below within a period of four weeks from today, the petitioner, named above, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Rohtas, Sasaram, in connection with complaint case no. 114 of 2011 (Tr. No. 1240 of 2014), subject to the conditions laid down in Section 438(2) of the Code of Criminal Procedure, 1973 with the further following conditions:- (i) Along with the bail bonds the petitioner shall produce receipt/evidence showing payment /deposit of a sum of Rs. 3,000/- (three thousand) in favour of the complainant/wife.
