Petitioners apprehend their arrest in a case registered for the offence punishable under Section 457, 380 of the Indian Penal Code.

As per the prosecution case, on 08.06.2021 the informant got information that theft has been committed in his house and when he reached at his house he saw that ventilator of his house was broken and 25 sarees, ornaments and cash of Rs. 10,000/- have been taken away by the miscreants. Later on, informant came to know that these petitioners, residents of Ward No.8, Anand Nagar, have committed the theft.

Patna High Court CR. MISC. No.55694 of 2021(2) dt.30-06-2022 2/2 Learned counsel appearing for the petitioners submits that petitioners are innocent and have falsely been implicated in the case. Petitioners and informant are neighbours and due to previous enmity they have been implicated in this case. The informant has not disclosed source of information from where he came to know that petitioners have committed the offence. Petitioners have got clean antecedent.

Learned counsel appearing for the State opposes the prayer for anticipatory bail.

Considering the facts of the case and clean antecedent of the petitioners, let the petitioners, above named, in the event of their arrest/ surrender within a period of six weeks from today shall be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial MagistrateVIII, Bhojpur, Ara in connection with Piro PS case No.192/2021, subject to conditions laid down u/s 438(2) of the Cr. P. C.
