The learned counsel for the petitioner is directed to remove all the defects pointed out by the office within one month.

The petitioner apprehends his arrest in connection with Muffasil P.S. Case No. 549 of 2018 registered for offence punishable under sections 20 (a) (ii)A, 27(A) of N.D.P.S. Act. The learned counsel for the petitioner has submitted that the main accused Shyam Kishore Tiwari, who was arrested at the spot, has been granted bail. The name of the petitioner has been figured in self inculpatory confessional statement of coaccused Shyam Kishore Tiwari, who apprised the police party

Patna High Court CR. MISC. No.40748 of 2020(3) dt.25-01-2022 2/2 that the present petitioner used to supply him Ganja. The learned counsel for the petitioner has further submitted that FIR shows itself that the present petitioner is auto-ricksaw driver. The criminal history of the present petitioner was called for, which is available at flag 'A', which shows that he has no criminal antecedent.

Considering the above mentioned facts and circumstances, the petitioner above named, in the event of his arrest or surrender, within four weeks from today, is directed to be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned District and Sessions Judge, West Champaran at Bettiah in connection with Muffasil P.S. Case No. 549 of 2018, subject to condition as laid down under section 438(2) Cr. P.C. Office shall ensure that all defects are removed by the petitioner within the stipulated time mentioned hereinabove, failing which, the matter shall be brought to the notice of this Court.
