On account of non-compliance of peremptory order dated 20.03.2017 instant appeal has met with ultimate result. At the present juncture learned counsel for the appellant has submitted that typing of annexures having annexed with the written report is not possible. Moreover, it has also been submitted that office is taking dual policy while bail petition filed on behalf of co-accused Rajesh Kumar, Cr. Appeal (SJ) No.352/2017, no such defect has been pointed out, but so far present appeal is concerned, office is insisting upon.
Office is directed to see and in case, no such defect has been pointed out in Cr. Appeal (SJ) No.352/2017, then in that event, the defect so pointed out at his end be ignored.
Patna High Court Cr.Misc. No.25535 of 2017 (2) dt.21-06-2017 With the aforesaid direction Cr. Appeal (SJ) No.485/2017 is directed to be restored to its original status. Accordingly, Cr. Misc. No.25535/2017 is allowed. (Aditya Kumar Trivedi, J.) Prakash Narayan U T
