Learned counsel for the petitioner submit that petitioner was granted anticipatory bail by this Court vide order dated 26.07.2021 passed in Criminal Miscellaneous No. 28491 of 2021, in which four weeks time was granted to the petitioner to surrender before the court below but due to some communication gap between the petitioner and the learned counsel appearing on his behalf, the information about passing of the order dated 26.07.2021, was not communicated to him within time, as such, petitioner could not surrender before the court below within stipulated time.

Patna High Court CR. MISC. No.57645 of 2021(2) dt.06-10-2021 2/2 In view of the submission made above, petitioner is granted 8 weeks further time to surrender before the court below.

The order dated 26.07.2021 passed in Criminal Miscellaneous No. 28491 of 2021, is modified to the extent as indicated above.

This modification application is allowed.
