JUSTICE BIRENDRA KUMAR ORAL ORDER 12-07-2017 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State.
The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 385/387/504/34 of the Indian Penal Code.
Allegation against the petitioners, who are family members, is that they demanded ransom from the informant to allow the informant to make construction on the referred land. Submission of the learned counsel for the petitioner is that there was land dispute between the parties inasmuch as Manjula Mahaseth has executed a power of attorney in favour of co-accused Jay Narayan Yadav in the year 2002 and in pursuance
Patna High Court Cr.Misc. No.25304 of 2017 (3) dt.12-07-2017 2/2 of that power of attorney Jay Narayan Yadav executed registered sale deed in the year 2007 in favour of some other person. Manjula Mahaseth executed a registered sale deed in respect of the same land in favour of the informant subsequently. Considering the background of the allegation, let the petitioners, above named, in the event of their arrest or surrender before the Court below within a period of thirty days from the date of receipt of the order, be released on anticipatory bail on furnishing bail bonds of Rs.20,000/- (Twenty Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Darbhanga/Successor Court in connection with Laheriasarai Police Station Case No.
85 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. With further condition that petitioners shall fully cooperate with the investigation and trial of the case, failing which the Court-below shall be at liberty to take steps for cancellation of the bail-bonds of the petitioners in this case.
