The petitioner is apprehending his arrest in connection with Complaint Case no.657 of 2014 registered for offences punishable under Sections 420, 467, 468, 323, 504,506 of the Indian Penal Code.

Allegation against the petitioner is that he made an agreement for sale of a piece of land with O.P.No.2 and took consideration money of Rs.52,000/- but he has registered the land in favour of his wife.

Submission of the learned counsel for the petitioner is that he has returned Rs.11,000/- to the complainant and still he is ready to return rest of the amount.

Patna High Court Cr.Misc. No.41505 of 2018 (3) dt.10-09-2018 2/2 Heard learned A.P.P. and from perusal of the record, it appears that notice was issued to the O.P.No.2 and he has received the notice but no one appears on behalf of him. . Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner surrender before the learned court below within a period of six weeks from the date of order along with a bank draft of Rs.41,000/- payable to O.P.No.2 and if such amount is deposited, the petitioner shall be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned SDJM, Madhepura in connection with Complainat Case No.657 of 2014.

The aforesaid amount shall be released in favour of O.P.No.2 and that will be subject to result of the case. With the aforesaid observation, this application is disposed of.
