19.01.2015 Heard learned counsel for the Petitioners and the State.
The Petitioners seek bail in Roh P.S. Case No. 44 of 2002 instituted for the offences under Sections 147, 148, 149, 342, 307, 302 and 427 of the Indian Penal Code and Section 27 of the Arms Act pending before the Chief Judicial Magistrate, Nawada.
Considering that there is direct allegation against the Petitioner of having committed the murder of two persons and they kept absconding for a number of years even though they were named in the First Information Report and have criminal antecedents, I am not inclined to grant bail to him. The prayer for bail is rejected. The Trial Court is directed to expedite the trial
Patna High Court Cr.Misc. No.32557 of 2014 (3) dt.19-01-2015 and for which reason it shall send a list of the witnesses fixing specific dates for production of the witnesses along with a copy of this order, to the Superintendent of Police, Nawada, and the Superintendent of Police, Nawada is directed to ensure production of the witnesses on the date so fixed by the Trial Court so that there is no further delay in trial.
