Petitioner is languishing in custody since 20.02.2014 in a case registered for the offences punishable under Sections 341, 323, 504, 506 of the Indian Penal Code, 3/4 of the Dowry Prohibition Act and 3(I) (X) of the S.C./S.T. Act.
Accusation is of torture for non-fulfillment of dowry demand.
It is submitted by the learned counsel for the petitioner that it is alleged that the petitioner used to assault the informant, though the case has not been registered under Section 498A of the Indian Penal Code. It is further submitted
Patna High Court Cr.Misc. No.24461 of 2014 (4) dt.10-02-2015 that the petitioner performed inter caste love marriage hence, there is no question of making demand of dowry or torture. Considering the nature of accusation and the period under custody, let the above named petitioner, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Ist Class, Bhagalpur in connection with Lodipur P.S.
