JUSTICE VINOD KUMAR SINHA ORAL ORDER 20-08-2018 The petitioner is apprehending his arrest in connection with Gamharia P.S. Case No. 63/2014, registered for offences punishable under Sections 147, 148, 149, 341, 323, 324, 307, 504 and 302 of the Indian Penal Code.
Allegation against the petitioner is of assault to the informant and others.
Submission of learned counsel for the petitioner is that earlier the case was not found true against the petitioner and he was not sent up for trial. However, he has been summoned under Section 319 of the Cr.P.C. for facing the trial. Moreover, no specific allegation has been attributed to him. Learned counsel for the State opposed the prayer for bail and submitted that there is specific allegation against the petitioner

Having heard both sides, considering the facts and circumstances of the case and the nature of accusation, I am not inclined to grant privilege of anticipatory bail to the petitioner rather he should surrender before the court below and pray for regular bail which would be considered on the basis of the materials available on record and shall dispose of the same, if possible on same day.
This application is accordingly disposed of.
