JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 31-01-2022 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in K.Hat P.S. Case No. 476 of 2021, registered for the offence punishable under Sections 376, 323 and other allied sections of the Indian Penal Code and section 3, 4, 5 and 6 of the ITP Act.

As per the FIR, petitioner and his family members pushed the informant in the flesh trade.

It is submitted on behalf of the petitioner that petitioner has falsely been implicated in this case. The victim in her statement recorded u/s 164 Cr. P. C. has only stated that this petitioner was in company of other accused persons who were indulged in flesh trade. The thrust of accusation is against Manju Devi and and Suraj Kumar. There is no allegation of overt act or sexual assault against the petitioner. Petitioner claims clean antecedent and he is in custody since

Patna High Court CR. MISC. No.57450 of 2021(2) dt.31-01-2022 2/2 10.06.2021. Investigation is complete. Similarly situated coaccused has already been allowed bail by this Court vide order passed in Cr.Misc.No. 51384 of 2021.

Learned counsel appearing for the State opposes the prayer for bail.

Considering the facts and circumstances of the case, the petitioner above-named, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Purnea in connection with K. Hat Sahayak P.S. Case No. 476 of 2021.
