JUSTICE VINOD KUMAR SINHA ORAL ORDER 12-07-2019 This is an application for grant of anticipatory bail in connection with Bajpatti P.S. Case No.111 of 2019, disclosing offences under Sections 341, 323, 324, 307, 379, 354(B), 448, 504, 506, 34 of IPC.

Prosecution story is that petitioners and other accused persons came variously armed assaulted the informant and

Patna High Court CR. MISC. No.43082 of 2019(2) dt.12-07-2019 2/2 specific allegation against Khus Nandan Mandal and Rup Lal Mandal and not against the petitioners.

Submission of the learned counsel for the petitioners is that informant has grudge against the accused Khus Nandan Mandal and there is no specific allegation of overt act against the petitioners. They have falsely been implicated in this case. Heard learned A.P.P. also.

Having heard both sides, considering the above submission, this application is allowed. Let the petitioners, above named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount to the satisfaction of learned Sub Divisional Judicial Magistrate, Pupri, Sitamarhi, in connection with Bajpatti P.S. Case No. 111 of 2019, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
