JUSTICE ARVIND SRIVASTAVA ORAL ORDER 18-07-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner apprehends arrest in connection with Barari P.S. Case No. 214 of 2016 registered under Sections 376, 120B of the Indian Penal Code.

Learned counsel appearing on behalf of the petitioner submits that petitioner and the informant have married in a temple on 09.10.2016 and are living together as husband and wife. Certificate of marriage is annexed as Annexure-4 to the supplementary affidavit filed today. The case has been compromised between the parties. Compromise petition has been annexed as Annexure-2 to this application.

Having considered the facts and circumstances of

Patna High Court Cr.Misc. No.26051 of 2017 (3) dt.18-07-2017 the case, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate, Katihar in connection with Barari P.S. Case No. 214 of 2016 subject to the condition as laid down under Section 438(2) of the Cr. P.C.
