Permission is accorded.

Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner apprehends his arrest in connection with Bihar P.S. Case No. 84/2020 registered for the offences punishable under Sections 379/411 of the Indian Penal Code. It is submitted by learned Advocate for the petitioner that the name of petitioner surfaced in the confessional statement of the co-accused and apart from that, there is no other material against this petitioner. He further submits that the petitioner has a clean antecedent.

Let the petitioner above named be released on bail, in the event of his arrest or surrender before the court below within a period of eight weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Nalanda, (Bihar), in connection with Bihar P.S. Case No. 84/2020, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C. Learned court below is directed to release the petitioner on provisional anticipatory bail and, thereafter, verify his criminal antecedent. If the petitioner is found having a clean antecedent, the provisional anticipatory bail, is confirmed and if there is some antecedent against the petitioner, then the provisional bail shall be cancelled.
