The petitioner is apprehending his arrest in a case registered for the offences punishable under Section 379 of the Indian Penal Code and Section 135 of the Electricity Act. Allegation is of commission of theft of electricity by surpassing the meter.

Considering the nature of allegation, in my view, this is not a fit case for grant of anticipatory bail. Hence, prayer is refused in connection with Lakhisarai Police Station Case No.329 of 2016 pending in the court of learned Chief Judicial Magistrate, Lakhisarai.

If, the petitioner disputes the manner of calculation

Patna High Court Cr.Misc. No.39135 of 2018(7) dt.26-09-2018 2/2 of loss to the Electricity Company and files representation, the Authority shall dispose of the same by a reasoned order, as per law.
