JUSTICE DINESH KUMAR SINGH ORAL ORDER 09-01-2015 The petitioner is languishing in custody in a case registered under section 363/366 (A) of the Indian Penal Code. The accusation is of enticing the minor daughter of the
Patna High Court Cr.Misc. No.33115 of 2014 (3) dt.09-01-2015 2 / 2 informant. It is submitted that in her statement under section 161 Cr.P.C. the victim has admitted that she, on her own ,went in the company of the petitioner and married the petitioner. In the medical report the victim has been assessed as 17 to 19 years by the doctor. The informant has subsequently filed an application for compromise.
Considering the above facts, let the above named petitioner be released on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Purnea in connection with Sadar P.S. Case No. 360/2002 corresponding to G.R. No. 2076/2002.
Since it is a case of 2002, the learned court below will be at liberty to cancel the bail bonds of the petitioner if he defaults for two consecutive occasions or if such a complaint is made that he has deserted the victim girl.
