The petitioner seeks bail in connection with Pali P. S. Case No.24 of 2021, instituted for the offences under Sections 363 and 365 of the Indian Penal Code and Sections 10 and 11 of the Prohibition of Child Marriage Act.

The learned counsel for the petitioner submits that the petitioner is in custody since 05.06.2021, he is a person with clean antecedent and charge-sheet has been submitted in this case.

The learned counsel for the petitioner further submits that the informant alleges that his minor brother Raju Kumar was taken to the house of Jai Kishore Yadav by the petitioner on 22.04.2021 while he had gone to watch the cricket match. On the same day, the victim was married to the daughter of Jai Kishore Yadav. His brother after taking the accused persons in

The learned counsel for the petitioner submits that from perusal of the allegation, it would manifest that the informant alleges that his minor brother was forcefully married to the daughter of Jai Kishore Yadav. The learned counsel submits that he is relative of Jai Kishore Yadav and as such, he has been falsely implicated in the present case when Jai Kishore Yadav has already been granted by the learned Court below. Learned A.P.P. opposes the bail application.

Considering the fact that the petitioner is in custody, he is a person with clean antecedent and charge-sheet has been submitted in this case, the petitioner, above-named, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 5,000/- (Rupees Five Thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-1st, Jehanabad in connection with Pali P. S. Case No.24 of 2021. The application stands allowed.
