====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 27-08-2025 At the outset, learned counsel for the petitioners seeks permission to withdraw this bail petition in respect of petitioner no. 1 & 2.

2. The anticipatory bail petition stands dismissed as withdrawn, so far as petitioner no. 1 & 2 are concerned.

3. Rest of petitioners (i.e. petitioner nos. 3 & 4) apprehend their arrest in a case registered for the offence under Sections 126(2), 115(2), 117(2), 118(1), 109(1), 351(2), 351(3), 3(5) and 303(2) of the B.N.S., 2023.

4. As per prosecution case, on the alleged date and time of occurrence, all the F.I.R. named accused persons

Patna High Court CR. MISC. No.50711 of 2025(3) dt.27-08-2025 2/2 including these petitioners, armed with lathi-danda, assaulted informant and his son.

5. Learned counsel for the petitioners submits that petitioners have been falsely implicated in this case due to previous enmity and village politics. As per injury report, the injuries, caused by petitioners/Chandan Kumar and Virbahadur Singh, are simple in nature. Petitioners claim clean antecedent.

6. Learned A.P.P. for the State and learned counsel for the informant opposed the prayer for anticipatory bail.

7. Considering the nature of injury and clean antecedent, in the event of arrest/surrender within a period of eight weeks from today, let the petitioner no. 3 & 4 namely Chandan Kumar and Virbahadur Singh, be enlarged on bail on furnishing bail-bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st Class, Gopalganj in connection with Barauli P.S. Case No. 53 of 2025, subject to condition as laid down under Section 482(2) of the B.N.S.S., 2023.
