JUSTICE SANJAY PRIYA ORAL ORDER 14-08-2018 Heard learned counsel for the petitioner and the State. The petitioner apprehends his arrest in Pipra P.S. Case No.185 of 2016 instituted for the offence under Section 304(B)/34 of the Indian Penal Code pending in the court of learned Chief Judicial Magistrate, Motihari, at Motihari East Champaran Counsel for the petitioner has submitted that petitioner is husband of the deceased.

In the written report, it is alleged that daughter of informant was tortured by the petitioner and other accused persons for demand of motorcycle. It is further alleged that Dewar (brother-in-law) of daughter of the informant came and brought her daughter to her matrimonial house. The husband of the

No.37746 of 2018 (3) dt.14-08-2018 2/2 deceased had gone out side one month ago from the date of occurrence and under conspiracy with each other, on 6.11.2016 in the night, on abetment of husband of the deceased (petitioner) along with other accused persons caused death of his wife by strangulation.

Case diary has been received.

The postmortem report of deceased is available in the case diary wherein the Doctor has found cause of death is asphyxia due to strangulation.

Therefore, this Court is not inclined to grant anticipatory bail to the petitioner.

Prayer for anticipatory bail of the petitioner stands rejected.

Petitioner may surrender before the court below and make prayer for regular bail.
