JUSTICE PARTHA SARTHY ORAL ORDER 17-03-2021 Heard learned counsel for the petitioner and learned APP for the State through video conferencing. The petitioner has filed the instant application for grant of regular bail in connection with Mufassil P.S. Case no. 290 of 2020 registered under section 30(a) of the Bihar Prohibition and Excise Act, 2016.

As per allegation in the FIR, 41.265 litres of liquor is stated to have been recovered from near Hanumangarhi from one Mahadeo Kumar who on earlier occasion also was made an accused in a case under the Excise Act. It is further stated that the petitioner and others happen to be a friend of the said Mahadeo kumar.

It is submitted by learned counsel for the petitioner

No.41147 of 2020(2) dt.17-03-2021 2/2 that except for the statement that the petitioner happens to be a friend of the aforesaid Mahadeo Kumar from whom the alleged recovery of liquor is stated to have taken place, there is no other material against the petitioner. He is in custody since 10.10.2020 and has no criminal antecedent.

The application for bail is opposed by learned APP for the State. .

Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case, the Court is inclined to enlarge the petitioner on bail. The petitioner is directed to be enlarged on bail in connection with Mufassil P.S Case no. 290 of 2020 on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge II-cum- Special Judge, Begusarai. (Partha Sarthy, J) Prakash/- U
