====================================================== CORAM: HONOURABLE MR. JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 19-01-2015 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The first information report of present case was instituted on 28-05-2011. The statement of witnesses was recorded in course of investigation and some witnesses at paragraphs-6, 11 & 20 stated the name of the petitioner but submission on behalf of the petitioner is that one, Kanhaiya Yadav was arrested on 08-092010 in connection with Charpokhari P.S. Case No. 146 of 2010 and the said Kanhaiya Yadav named the petitioner in his confessional statement and after that, the above-said witnesses claimed to have identified the petitioner committing the alleged crime. It is further contended by him that the petitioner has got no criminal antecedent and having similar allegation, one co-accused, Butan Choudhary has already been granted privilege of bail by the

Patna High Court Cr.Misc. No.33695 of 2014 (3) dt.19-01-2015 Sessions Judge, itself.

Considering the aforesaid facts and circumstances as well as submission of the parties, let the petitioner named above, be released on bail on furnishing bail bond of Rs 10,000/- (ten thousand) with two sureties of the like amount each in connection with Charpokhari P.S. Case No. 56 of 2011 corresponding to Sessions Trial No. 294 of 2013 to the satisfaction of F.T.C.-III, Ara.
