The petitioner apprehends his arrest in connection with Manigachi P.S. Case No. 240 of 2023 registered for the offences punishable under Section 392 of the Indian Penal Code.

Prosecution case in a nutshell is that the informant along with his two staffs went to deposit cash to the tune of Rs. 11,00,000/- in the SBI, but in the way, four miscreants ridden on two motorcycles surrounded the informant and looted his bag

Patna High Court CR. MISC. No.49462 of 2024(3) dt.09-08-2024 2/3 containing Rs. 11,00,000/- and two mobiles phones, thereafter they fled away.

Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence as alleged against him and has falsely been implicated in the present case. Petitioner is not named in the FIR. Name of the petitioner transpired on the basis of confessional statement of co-accused, namely, Devesh Kumar Jha @ Rishi Baba, who has been granted bail by this Court vide order dated 19-04-2024, passed in Cr. Misc. No. 24458 of 2024. Nothing has been recovered from the possession of the petitioner. Petitioner claims clean antecedent.

On the other hand, learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner. 6.

Considering the rival submissions made by the learned counsel for the parties, let the petitioner above-named, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Manigachi
