2. Petitioner seeks regular bail in connection with Beldaur P.S. Case No. 131/ 2025 dated 29.04.2025 registered for the offence(s) punishable under Section(s) 126(2), 115(2), 118(1), 117(2), 109., 303(2), 352, 351(2), 351(3) and 3(5) of the BNS.

The main submissions advanced by the petitioner's counsel are that both the parties are agnates and in between them there was a dispute over the passage at the relevant time of the occurrence, in the FIR there is no specific allegation against the petitioner and two named and five unknown persons were alleged to have assaulted the informant, his wife and son but the nature of the injuries found on their body does not corroborate the manner of the occurrence as the informant's wife and son

Patna High Court CR. MISC. No.44333 of 2025(3) dt.21-07-2025 2/2 sustained simple injuries, though, the informant sustained one grievous injury but the same was found on non vital part of his body. It is lastly submitted that petitioner has fair and clean antecedent, languishing in jail since 30.04.2025 and against him investigation has been completed.

4. The learned APP appearing for the state has opposed the bail prayer of the petitioner.

Considering the aforesaid submissions advanced by the petitioner's counsel and mainly the petitioner's fair and clean antecedent and his custody period and also nature of the injuries sustained by the injured persons coupled with the facts that both the parties are agnates and only one grievous injury was found on the non vital part of the body of the informant and the same is not specifically attributed to this petitioner, in my opinion, it is a fit case for grant of bail to the petitioner. Accordingly, let the petitioner named-above be released on bail in connection with Beldaur P.S. Case No. 131/ 2025 on furnishing bail bond of Rs. 20,000/-( Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of the Court concerned.
