JUSTICE VINOD KUMAR SINHA ORAL ORDER 18-07-2019 Petitioners seek bail in anticipation of their arrest in connection with Manpur P.S. Case No. 89 of 2019 registered for the offence punishable under Sections 379/34 of the Indian Penal Code.
Allegation as per FIR is that submersible boring of the informant was taken away by four miscreants, out of whom two were identified, who are petitioners.
Submission of learned counsel for the petitioners is that they have falsely been implicated which will appear from the fact that informant has raised no alarm for apprehending them.
Heard learned APP also, who has opposed the prayer
Patna High Court CR. MISC. No.44237 of 2019(2) dt.18-07-2019 2/2 for anticipatory bail stating that petitioners are named in the FIR and they have also identified at the time of occurrence. In view of above facts and circumstances, I am not inclined to grant the privilege of anticipatory bail to the petitioner. They may surrender and pray for regular bail, which shall be considered on its own merit, without being prejudiced by this order and, if possible, to be disposed of on the same day. With the above observation, this application is dismissed.
