The petitioner seeks bail in connection with Complaint Case No.2530 of 2017 in which cognizance has been taken under Section 498A of the Indian Penal Code and Section 4 of the D. P. Act.

The learned counsel for the petitioner submits that the petitioner is in custody since 24.02.2021 and he is a person with clean antecedent.

The learned counsel for the petitioner further submits that the complainant alleges that she was married to the petitioner in the year 2015. After marriage, the petitioner and his family members started demanding motorcycle. Further, on non-

Patna High Court CR. MISC. No.56588 of 2021(3) dt.02-03-2022 2/2 fulfilment of the demand, the complainant was assaulted and ousted from the house along with the child.

The learned counsel for the petitioner submits that petitioner is willing to keep the complainant and the child with full honour and dignity, but the complainant is not willing to come back as she wants the petitioner to keep his aged mother and to stay separately. It is further submitted that petitioner has remained in custody for an year.

Learned A.P.P. opposes the bail application.

Considering the fact that petitioner is in custody for nearly an year and is a person with clean antecedent, the petitioner, above-named, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 5,000/- (Rupees Five Thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Muzaffarpur (East) in connection with Complaint Case No.2530 of 2017. The application stands allowed.
