ANJANA MISHRA ORAL ORDER 06-07-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.
The petitioner apprehends his arrest in connection with a case registered for the offences punishable under Sections 147/452/323/379/504/506 of the Indian Penal Code. Learned counsel for the petitioner submits that admittedly false and concocted case has been lodged against the petitioner regarding snatching of chain and mobile phone. In fact, the same mobile is well being used by the informant and since there was a dispute regarding payment of cost of books which have been supplied to the school of the informant, the present petitioner has been implicated in the present case giving a concocted story which is altogether ridiculous and not worthy of credence. Having heard learned counsel for the petitioner and the State, it appears that the case has been lodged with the vendetta and the informant has a previous enmity with the petitioner.

No.27001 of 2017 (2) dt.06-07-2017 P2/2 Considering that the petitioner has no criminal antecedent and also the nature of dispute as alleged, let the petitioner abovenamed, in the event of his arrest / surrender within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-Divisional Judicial Magistrate, Patna City, Patna, in connection with Mehdiganj P.S. Case No. 26/2017, subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
