The petitioner is languishing in custody since 17.05.2014 in a case registered for the offences punishable under Sections 376/34 of the Indian Penal Code and 3/4 of Dowry Prohibition Act.

It is alleged that the petitioner established forceful physical relationship with the informant 6-7 months prior to the lodging of the FIR and thereafter kept continuing establishing physical relationship when the informant got pregnant and the petitioner assured to marry, but subsequently due to nonfulfillment of dowry demand he refused to marry. A statement has been made in para 3 of the petition that the petitioner has no criminal antecedent. The victim has been found aged about 19 years during medical examination.

Considering the delayed lodging of the case and the subsequent conduct of the informant, let the above named petitioner, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Ist Class, Purnea in connection with Amour P.S.
