ANJANA MISHRA ORAL ORDER 14-07-2017 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is apprehending his arrest in connection with Bakhtiyarpur P.S. Case No.493 of 2015, giving rise to Spl. Case No.01 of 2016 for allegedly having committed the offence under Section 7 of the Essential Commodities Act.

The allegation against the petitioner is that certain bags of wheat had been seized from Saini Tola Chowk, which has the mark of F.C.I., in front of the godown of Birendra Bhagat and Pawan Jaiswal and since the Drivers could not be traced, it is suspected that the petitioner was involved in the said case as he is the Manager of PACCS and is running the

Patna High Court Cr.Misc. No.27642 of 2017 (2) dt.14-07-2017 2/2 P.D.S. shop in the name of PACCS for the last four years. It is submitted that the petitioner's licence has never been under cloud and he is having his business with all integrity. Considering the nature of allegations and that six coaccused persons of the present case have been extended the privilege of anticipatory bail, the details of which have been mentioned in paragraph 18 of the petition, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bond of `10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-Divisional Judicial Magistrate, Saharsa, in connection with Bakhtiyarpur P.S. Case No.493 of 2015, giving rise to Spl. Case No.01 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
