JUSTICE BIRENDRA KUMAR ORAL ORDER 05-09-2018 Heard learned counsel for the petitioner and learned APP for the State.

The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 406,420,467,468 and 471 of the Indian Penal Code. Petitioner is holder of a saving account in the State Bank of India, Maner Branch. Branch Manager of the said Bank is informant of this case. Allegation is that cloned cheques were produced under a conspiracy by the petitioner and others for deposit in the bank account of the petitioner. The Bank-Authorities detected the aforesaid conspiracy and fraud and lodged the FIR.

Learned counsel for the petitioner submits

Patna High Court Cr.Misc. No.32647 of 2018 (4) dt.05-09-2018 2/2 that the petitioner was not aware as to how the two cheques of Rs. 1,98,400/- and 1,91,450/- were deposited in the bank account of the petitioner.

It is not acceptable that without knowledge of the account holder, cheque would be deposited in the bank account of any account holder.

Hence, considering the nature of allegation, I am not inclined to enlarge the petitioner on anticipatory bail in connection with Maner Police Station Case No. 289 of pending in the court of learned A.C.J.M.-II, Danapur/successor court.
