The petitioner is languishing in custody since 02.05.2014 in a case registered for the offences punishable under Sections 366A and 120B of the Indian Penal Code. The accusation is of kidnapping the minor daughter of the informant.

It is submitted by learned counsel for the petitioner that in 164 Cr.P.C. statement the victim has got her age recorded as 19 years when the court has assessed as 17 years where the victim has accepted the fact that she was in love with the petitioner and she has already married with the petitioner on 21.04.2014.

Patna High Court Cr.Misc. No.32970 of 2014 (03) dt.09-01-2015 2/2 Considering the aforesaid facts, let the above named petitioner, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Ist Class, Birpur, District - Supaul in connection with Karjain P.S. Case No. 19 of 2014.
