JUSTICE ARUN KUMAR JHA ORAL ORDER 25-07-2023 Mr. Kaushal Kumar, learned Junior counsel to Mr. Anjani Kumar Sinha No-1, who is Advocate On Record, submits that Mr. Anjani Kumar Sinha No.1, learned counsel for the appellant, is presently hospitalized and is undergoing chemotherapy and he has instructed him to withdraw the present second appeal.

2. The learned counsel further submits that the sole appellant in this case has since died and the respondents are his wife and son, respectively who are his legal heirs as well and this appeal could not proceed and it has become nonprosecutable. Thus, he prays that this appeal be dismissed as withdrawn.
