JUSTICE VINOD KUMAR SINHA ORAL ORDER 10-08-2017 The appellants seek pre arrest bail in connection with SC/ST P.S. Case No. 31 of 2016, registered for offences punishable under Sections 147, 148, 149, 341, 323, 379, 307, 504 and 506 of the Indian Penal Code and section 3(i)(x) (3)(2)(v) of SC/ST Act.
Allegation against the appellants and other accused persons is that they surrounded the informant and assaulted him and abused him by calling his caste name.
It has been submitted on behalf of the appellants that now the parties have now settled their disputes and informant has also filed a petition before the Court of Special Judge in this regard. Further appellants are ready to abide by any condition imposed on
Patna High Court CR. APP (SJ) No.1675 of 2017 (3) dt.10-08-2017 them for grant of bail.
Heard learned Special P.P. also.
Having heard both sides, in view of the fact that a prima facie case under the above mentioned Section of SC/ST Act is made out against the appellants, as such, this appeal is not maintainable.
Let appellants surrender before the special court and make prayer for regular bail and if any such application is filed, the special court after considering the submission of learned counsel for the appellants that the parties have settled their disputes, shall pass an appropriate order, preferably on the same day, without being prejudiced by the order of this Court.
