23-01-2015 Heard learned counsel for the petitioner, learned A.P.P. for the State and learned counsel for the opposite party no. 2 (complainant).

The petitioner was granted provisional bail in Complaint Case No. 464 of 2013 dated 24.10.2013 instituted under Sections 323/379/341/504/494/498A of the Indian Penal Code and 3/4 of the Dowry Prohibition Act by order dated 07.11.2014 and notice was issued to the opposite party no. 2. Today learned counsel appearing for the opposite party no. 2 submits that she is living with the petitioner in the matrimonial

Patna High Court Cr.Misc. No.33313 of 2014 (5) dt.23-01-2015 2/3 home and has no grievance. However, it is submitted that her interest may be protected.

In view of the aforesaid, the petitioner is directed to appear before the court below on the next date fixed in the case and file an undertaking that he shall keep the opposite party no. 2 with full dignity, honour and security and shall also provide for all her other needs and that she shall be allowed to talk to and meet her relatives without any objection either by the petitioner or his family members. The Court shall thereafter fix dates in the case every month when both the petitioner and opposite party no. 2 shall appear and the Court shall record a finding with regard to the relationship. If after six months the Court finds that the relationship stands restored and the opposite party no. 2 has no complaint against the petitioner, the bail shall be confirmed.

The opposite party no. 2 shall be at liberty to file an application if there is any violation of the terms and conditions of the undertaking or she is otherwise threatened either by the petitioner or his family members. If such a petition is filed, the Court concerned, after hearing the parties shall pass appropriate orders including cancellation of the bail bonds of the petitioner. Such liberty to the opposite party no. 2 shall continue

Patna High Court Cr.Misc. No.33313 of 2014 (5) dt.23-01-2015 3/3 even after the bail of the petitioner has been confirmed. The application stands disposed off in the aforementioned terms.
