2. The petitioner seeks regular bail in Mali P.S. Case No. 30 of 2024 registered for the offence punishable under Sections-147, 148, 149, 323, 341, 324, 307, 504 of the Indian Penal Code.

3. Allegedly, when the grandfather of the informant was standing on the road, the accused persons having armed with weapons came there. Co-accused, Deepak Ram made scuffle with him whereas other accused persons are said to have assaulted the informant's grandfather with gadansa.

4. Learned counsel for the petitioner has submitted that there is case and counter case between the parties. The petitioner is a person of clean antecedent. The specific

Patna High Court CR. MISC. No.51089 of 2024(2) dt.29-07-2024 2/2 allegation of assault to the informant is against co-accused Deepak Ram, Upendra Ram and Subhash Ram and not against the petitioner. The allegation against the petitioner is general and omnibus and he is in custody since 12-02-2024. It has also been submitted by learned counsel for the petitioner that for the same occurrence, the members of defence side has also lodged a case against the members of prosecution side and co-accused Deepak Ram who is father of the petitioner has permanently lost his vision due to head injury inflicted by the accused persons of that case.

5. Learned APP has opposed the prayer for bail.

Considering the aforesaid facts and circumstances, let the petitioner named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-VI, Aurangabad in connection with Mali P.S. Case No. 30 of 2024 with condition that the petitioner shall cooperate with the trial of the case and make himself available as and when required by the court.
