In this case, the petitioner is seeking anticipatory bail in connection with Fulwaria P.S. Case No.28 of 2017, registered for the offence punishable under Sections 341, 323, 307, 448, 304, 379, 427 and 506/34 of the Indian Penal Code. Allegation has been made that accused persons have entered into the house of the informant and started assaulting with iron rod, which caused injury on different parts of the body. Learned counsel for the petitioner submits that there is case and counter case between the parties and it was a simple altercation.
Looking to the nature of allegation, this Court is not
Patna High Court Cr.Misc. No.26959 of 2017 (2) dt.13-07-2017 2/2 inclined to grant bail to the petitioner. Accordingly, the prayer for bail is rejected. If the petitioner surrenders before the Court below within four weeks from today and prays for bail, the Court below will pass the order in accordance with law on the same day without being influenced by the order of this Court.
