The District Magistrate, Motihari is personally present in Court and has produced the records of this case. He has also produced the original application of the present petitioner which was sent much latter to the date mentioned in the advertisement.

It has been submitted in the said letter of the petitioner which is dated 12.05.2018 itself that he had sent his application by ordinary post.

In view of such submissions and there being a clear stipulation in the advertisement which has been annexed to the

Patna High Court MJC No.239 of 2015 (11) dt.10-07-2018 show cause filed earlier that all applications by eligible candidates were to be sent by registered post and that any discrepancy in the application would not be considered, this Court finds that nonconsideration of the case of the present petitioner is wholly in consonance with the settled principles of law and, therefore, no case of contempt, so far as it relates to the petitioner, is made out.
