2. Lastly, the prayer for bail of the petitioner was rejected by this Court vide order dated 07.12.2022 passed in Cr. Misc. No. 39840 of 2022.
3. By filing a supplementary affidavit, learned counsel for the petitioner submits that during trial, all the prosecution witnesses including victim, informant and others have become hostile. The doctor, namely, Dr. Pratibha Kumari, has also been examined during the trial, who deposed that at the time of examination no evidence of sexual assault was found. Further submission is that petitioner is in custody since 14.10.2020.

Having considered the period of custody and the fact that all the prosecution witnesses have become hostile, let the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Special Judge, POCSO Act, Patna in connection with Beur P.S.
