2. The petitioner seeks regular bail in connection with Mansahi P.S. Case No. 179 of 2025 registered for the offence under Section(s) 137(2) and 96 of the Bharatiya Nyaya Sanhita., 2023.

3. As per the prosecution case, the petitioner is accused of kidnapping the victim girl.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has not committed any offence. Petitioner is in custody since 23.03.2026 and has no criminal antecedents.

5. Learned A.P.P. for the State has vehemently opposed the prayer for bail.

6. I have considered the submissions of the parties and have gone through the records of the case. From the statement of the victim girl recorded under Section 183 of the BNSS, it appears that she had eloped with the petitioner on her own and had married him voluntarily and willingly.

7. Considering the aforesaid facts and circumstances, this application for regular bail is allowed.

8. Accordingly, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate-1st Class, Katihar/successor Court in connection with Mansahi P.S. Case No. 179 of 2025.

It is, however, clarified that the observations made herein are limited to the adjudication of the present bail application and shall not prejudice the case of the petitioner at any subsequent stage of the trial and this Court has not express any opinion on the merits of the case.
