The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 409, 420, 467, 468, 471 and 120(B) of the Indian Penal Code. It is a case of embezzlement and misappropriation of money of Rs.27.4216 lacks of public money.

It is submitted by learned counsel for the petitioner that the petitioner has falsely been implicated in this case. He further submits that Deputy Development Commissioner, Gopalganj passed an order and a copy of the same has been communicated to the petitioner whereas per rule of the MANREGA Act, 2005, Section 17 mention in letter no.274880 dated 08.07.2020, petitioner is liable to pay 2.5 percent of total

Patna High Court CR. MISC. No.56700 of 2021(2) dt.26-04-2022 2/2 amount i.e., Rs.68,554/- (Sixty eighty thousand five hundred fifty four) and vide letter dated 16.12.2020, the petitioner has deposited the same amount on 18.12.2021 in the account of beneficiary A/C No. 61310273370, IFC Code No. SBI0031501, which is supported by supplementary affidavit vide para-2 of this petition. Petitioner has got clean antecedent. Learned APP appearing for the State has opposed the prayer for anticipatory bail.

In the facts and circumstances of the case, let the petitioner, above named in the event of his arrest or surrender before the court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Gopalganj in connection with Bhore P.S.
