JUSTICE MOHIT KUMAR SHAH ORAL ORDER 19-07-2024 Though the present petition is by way of third attempt at the behest of the petitioner for grant of regular bail in connection with N.D.P.S.-31/2022 (arising out of Chausa P.S. Case No. 118 of 2022), registered for the offences punishable under Sections 20, 22, 23 and 24 of the N.D.P.S. Act, inasmuch as as all the earlier petitions, filed by the petitioner, for grant of regular bail, have all stood rejected by this Court, nonetheless, the learned counsel for the petitioner seeks not to press the present petition, however, seeks a direction upon the learned Court of Additional Sessions Judge-III-cum-Special Judge, NDPS Act, Madhepura, to expedite the trial, especially in view of the fact that after 15.12.2022, not even a single witness has been examined, although earlier to that four witnesses out of

Patna High Court CR. MISC. No.50175 of 2024(2) dt.19-07-2024 2/2 seven witnesses had stood examined.

Having regard to the facts and circumstances of the case, I deem it fit and proper to direct the learned Court of Additional Sessions Judge-III-cum-Special Judge, NDPS Act, Madhepura, to ensure examination of the remaining witnesses, within a period of six months from today and for that purpose, this Court authorizes the learned Trial Court to take appropriate steps including coercive steps, in accordance with law, to ensure appearance of the remaining prosecution witnesses before the Ld. Trial Court. It is expected that the Ld. Trial Court shall then conclude the trial expeditiously.

Accordingly, the present petition stands disposed off as not pressed.
