JUSTICE PRABHAT KUMAR JHA ORAL ORDER 18-10-2017 Heard learned counsel for the petitioners, learned counsel for the State and learned counsel for the informant. The petitioners apprehend their arrest in Hulasganj P.S. Case No. 24 of 2017 registered for the offences punishable under Section 307 and other Sections of the Indian Penal Code. The informant named the petitioners and alleged that for stealing away log of Sheesham, some verbal altercation took place on such Satyendra Yadav, petitioner no. 3 assaulted Subodh Kumar, son of the informant and Ravi Kumar assaulted Subodh Kumar with iron rod. Devendra Kumar, petitioner no. 2 and Pramod Kumar, petitioner no. 1 are alleged to have assaulted Binod.

Patna High Court Cr.Misc. No.27550 of 2017 (3) dt.18-10-2017 Learned counsel for the petitioners submits that the occurrence took place due to petty dispute putting the log of woods in the Holika Dahan. There is a counter version, but it appears that there is specific allegation against all these three accused persons that they assaulted Subodh Kumar and Binod. Subodh Kumar got as many as five injuries. The doctor has opined the injuries to be dangerous to life. Binod also got injuries. Considering the facts aforesaid, I am not inclined to enlarge the petitioners above named on anticipatory bail. Accordingly, the same is rejected.
