ANJANA MISHRA ORAL ORDER 13-07-2017 Heard learned counsel for the petitioner and learned counsel appearing on behalf of the State.
The petitioner apprehends his arrest in connection with Narpatganj P.S. Case No. 29 of 2017 for the offences registered under Sections 341, 323, 324, 379, 504 and 506/34 of the Indian Penal Code.
Learned counsel for the petitioner submits that the allegation against the petitioner is that he attacked the informant with Farsa but the said offence is under Section 323 and 324 of the Indian Penal Code which is bailable. It is further submitted that the allegation under Section 379 of the Indian Penal Code is general and omnibus and therefore, the petitioner need not be taken into custody.

No.27569 of 2017 (2) dt.13-07-2017 Considering the aforesaid facts and circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Araria in connection with Narpatganj P.S. Case No. 29 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
